User Eligibility The Websites are available for use only by individuals at least 18 years of age and able to form legally binding contracts under applicable law. At our sole discretion, we may restrict or terminate your eligibility to use the Websites at any time.
Designated Use The Websites are for use by our Registered Users to purchase items in an auction format (VAuctions.com) and a fixed price format (VCoins.com). All information, including item descriptions and images, on the Websites is protected by copyright. You must obtain permission from the copyright holder to use any information contained on VCoins or VAuctions. Collecting or gathering information from VCoins of VAuctions for use in aggregate or archival form is specifically prohibited.
You may not use any device, software, or procedure to interfere or attempt to interfere with any auction, offer, or internal management system that may affect the normal operation of the Websites. You may not attempt to reverse engineer, decompile, or duplicate our software or features. User Fees We reserve the right to modify our pricing policy as necessary to support the costs of offering our services. As a user of our service, you are responsible for paying all applicable taxes and costs for your equipment, hardware, software, service or any other expense incurred in order to initiate and maintain your use of our service. In our sole discretion, we may add to, alter, or discontinue a portion or all of our services at any time.
User Responsibilities and Cautions The Websites will not be responsible for, and has no control concerning the availability, quality, safety or legality of the items or services listed or advertised on our sites. All participating dealers have agreed to be bound by the VCoins Dealer Code of Ethics. We cannot warrant the truth or accuracy of listings, images, the ability of users to bid, buy or sell, or the ability of users to complete any transactions initiated by using our site. In the event of any dispute with one or more users, you release Vhobbies.com, LLC, VAuctions.com and VCoinsdisputes. Neither VHobbies.com, LLC or the Websites are responsible for any user-submitted content or information appearing on our site.
Bidding and Buying If you place an order for an item or bid on an item and your bid is accepted by the Seller, you are obligated to complete that transaction. Bids are not retractable. If you choose to bid on any item(s), you are certifying that you have the legal right to purchase and receive the item(s).
Your Given Information Information that is provided by you, to the Websites or our users during the course of any communication related to using our services is defined herein as "Your Given Information". With respect to Your Given Information: You are solely responsible for Your Given Information. Under any conditions, we reserve our right to take any actions with respect to such information we deem necessary or appropriate in our sole discretion, to protect against any possible loss or liability imposed on VHobbies.com, LLC or the Websites, our Users, anyone selling on any of our Websites, or our service providers, including any of our suppliers. Your Given Information and the use of any service(s) at VAuctions.com and VCoins.com: shall be accurate and honest; shall not infringe on any third party's copyright, trademark, patent, trade secrets, proprietary rights, rights of publicity or privacy; shall not violate any law, statue, ordinance, or regulation (including without limiting those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); shall not be defamatory, trade libelous, unlawfully threatening or harassing; shall not be obscene or contain pornography, or if regulated by law as some items or services may be, shall be posted in the appropriate category and shall be distributed to only the individuals that are legally permitted to receive such merchandise; shall not contain any computer related viruses, time bombs, worms, trojan horses, cancelbots or other programming procedures that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; shall not link directly to, or include descriptions of goods or services that are identical to those in your item listings, but priced or sold for lower than your established price as posted on the Websites; shall not be listed concurrently for sale on a website other than the Websites; shall not feature any content or access to, that you do not have the right to link to or include; shall not, by any of your actions, cause the Websites to violate any applicable laws, statutes, ordinances or regulations. As a user of the Websites, you grant us the right to use appropriate portions of Your Given Information for promotional or other purposes not violating rights you may have in that information, in accordance with the Websites Privacy Policy.
Manipulation Bids Consignors shall not place bids on their own auctions.
Limit of Liability IN NO EVENT SHALL VHOBBIES.COM, LLC, OUR WEBSITES, OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH OUR POLICIES AND USER AGREEMENT. OUR LIABILITY, AND THE LIABILITY OF OUR SUPPLIERS; TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCES IS LIMITED TO THE AMOUNT OF FEES YOU PAID TO US IN THE THREE (3) MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY.
Compliance with Laws You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your bidding on, listing, purchase and sale of items.
No Agency You and VHobbies.com, LLC are independent contractors, and no agency, partnership, joint venture, employee-employer of franchiser-franchisee relationship is intended or created by Our Terms of Use.
Law and Jurisdiction These Terms of Use and your use of the Websites are governed by the laws of the State of Texas, USA, without regard to its choice of law provisions. The courts of general jurisdiction located within Bexar County, Texas, USA, will have exclusive jurisdiction over any and all disputes arising out of, relating to or concerning these Terms of Use or the Websites.
By accessing or using any feature on our Websites or by submitting a User Registration form, you are verifying your agreement and compliance with all of the policies, terms and conditions as contained herein.

6. Security of Information
